Gainesville Murder and Manslaughter Lawyer

Florida Murder and Manslaughter Defense Attorney

In Florida, both murder and manslaughter charges are extremely serious.  Murder is a homicide due to premeditation (commonly referred to as “malice aforethought”) on the part of the accused. Premeditation describes an action that is carried out with planning or deliberation; malice aforethought describes a murder that is carried out intentionally, recklessly, and with extreme disregard for human life. There are also charges of 2nd and 3rd degree murder depending on the circumstances of the case. In Florida, murder carries a sentence of either life in prison or the death penalty.

Manslaughter typically falls into two categories: voluntary and involuntary. Voluntary manslaughter is basically the crime of killing another human being without premeditation or planning. Involuntary manslaughter occurs when a death results due to an act of recklessness or criminal negligence; it includes the charge of vehicular manslaughter, which is a very common form of involuntary manslaughter and is defined as a death that results because of criminal negligence or disobeying traffic safety laws. A manslaughter conviction in Florida carries a sentence of up to life in prison but does not include the death penalty.
